Please find below conditions applicable to our contracts:
1. Any superstructure repairs are not included in this quotation.
2. The main contractor must locate all services AC Mini Piling and Foundations Ltd shall not be held responsible for any loss damage or diversion of services such as gas water electricity or sewerage.
3. A confirmation of services, incorporating a customer checklist must be completed and signed five working days prior to our commencement on site.
4. No provision has been made for marking out of building lines, profiles or power positions unless specifically stated within our quotation. This must be carried out by the main contractor/others prior to our commencement on site. The setting of any levels prior to concreting is to be the responsibility of the main contractor. We will not accept any responsibility for incorrect building lines, pile positions or the level of any concrete poured.
5. Due to the machinery which we will be installing the piles, a level, well compacted and adequate working platform, free from obstructions will be required. Working platforms within the industry are now covered by a Working Platform Certificate Scheme with the publication by BRE of working platforms for Tracked Plant in conjunction with the HSE.
6. The rates quoted for the installation of reinforced ground beams etc are approximate only and will be subject to remeasure on completion of our works.
7. No responsibility shall be placed on the company for any piles which are displaced from their positions by any underground obstructions. All additional expense caused to ourselves thereby will not will be charged as an extra to the quoted price.
8. Our piles are designed for axial loads only and do not therefore take into account for horizontal, uplift or heave forces unless stated in our quotation.
9. Our piles are not designed to take into account any negative skin friction unless we are made aware of possibility at tender stage.
10. Any loss or damage to equipment due to underground obstructions shall also be charged as an extra to the quoted price.
11. Any loss or damage caused to our machinery/equipment whilst on site will be charged unless adequate security measures are in place ie. secure fencing, site cabins and/or site security.
12. The component will not be held liable for damages, howsoever caused to furniture, appliances or personal effects remaining within the area of the said works.
13. The company have not made any allowances for professional, district surveyors or local authority fees or additional works they may require, unless this is stated in our offer.
14. Any additional concrete used to over dig or incorrect levels, will be charged at the current rate per metre or part thereof.
15. Should a concrete pump be required due to access problems the associated costs will be charged as an extra to the quoted price.
16. Due to the unforeseen nature of piling works we are often unable to provide a fixed start date on one specific date. Programme start dates will therefore be given between a particular reasonable time period. No counter claims of any nature for any delays whatsoever to programme will be accepted.
17. Any items marked provisional are not included in the total amount of quotation.
18. The quoted depths are the minimum price payable per pile (from existing or formed ground level) and applicable to all contracts.
19. This is a fixed price quotation covering all piling work up to and including the quoted depths. The price quoted is the minimum price payable, any additional meterage will be charged at the quoted rates per meter.
20. No provision has been made for cutting down of piles or trimming of pile heads unless specifically stated in our quotation.
21. This quotation is net and firm for a period of 14 days.
22. The rates and prices offered a subject to payment of our invoice in full on completion of said works.
23. If payment is not received within the stipulated time the customer will pay to the company interest on outstanding monies at 8% over the current bank lending rate at the time of invoice.
24. Due to the unforeseen nature of our work and the large variations in the driving process times, it is very difficult to be precise with regard to contract duration and hence we do not accept liquidation and ascertained damages.
25. Should any account the passed for legal collection, all costs incurred in the recovery shall be charged (minimum 15% of outstanding monies).
26. Our official order confirmation agreeing to our terms, conditions and payment terms is required prior to our commencement on site and to enable programming of the said works.
27. Standing time for piling rigs, associated plant and labour whilst overcoming obstructions or due to circumstances beyond our control, will be charged. This items is intended to cover short duration standing time only, should excessive delays and continuous standing of our rig(s) occur, we reserve the right to temporarily move the rig and or operatives from site and re-mobilisation charges will apply.
The company cannot accept any liability for consequent delays to the contract in this circumstance.
28. Warning whilst piling is an excellent way of preparing your foundations it may not be suitable for certain ground conditions. If mining works are known in the area a geotechnical survey should be carried out by the property owner/client to determine the ground conditions before work commences. Any work carried out without the proper searches is at the owners/clients own risk and AC Mini Ppiling cannot be held responsible for any future problems that may arise.
